Nigel Farage faces a potential second Clacton by-election as a parliamentary investigation into whether he properly declared a £5million gift.

Reform UK leader Nigel Farage could face a second by-election in Clacton as the parliamentary standards commissioner prepares to deliver findings into whether he properly declared a £5million gift. The findings are expected within days, following an investigation into the multimillion-pound payment Farage received from cryptocurrency billionaire Christopher Harborne before returning to frontline politics ahead of the 2024 General Election. Farage, who was re-elected as Clacton MP in August with an increased majority of 12,784 votes, was interviewed by Parliamentary Standards Commissioner Daniel Greenberg last month.
The Reform UK leader has denied any wrongdoing, maintaining that the money was intended to fund his personal security. However, the investigation could have significant consequences for Farage’s political future if the commissioner refers the case to Parliament’s Committee on Standards.
Parliamentary rules require MPs to register relevant financial interests and benefits received during the 12 months before their election. The investigation centres on whether Farage should have declared the £5million gift from Harborne, a Thailand-based cryptocurrency investor who has previously supported political causes.
The commissioner is examining the circumstances surrounding the payment and whether parliamentary disclosure requirements were followed. A referral to the Committee on Standards would not automatically trigger a by-election. However, if the committee recommends a suspension and the House of Commons imposes one lasting more than 10 sitting days, a recall petition could be launched.

For a by-election to follow, at least 10% registered voters in Clacton would need to sign the petition within the prescribed period. Farage won Clacton at the 2024 General Election with a majority of 8,405 votes before extending his lead to 12,784 in the August by-election.
That contest attracted an unusually large field of 34 candidates, with satirical politician Count Binface, whose real name is Jonathan Harvey, emerging as Farage’s main challenger and securing 9,455 votes. The established parties largely stayed out of the August contest after Farage triggered the by-election himself.
The prospect of another vote would put the Essex seaside constituency back in the political spotlight, with the Conservatives reportedly preparing to select a candidate by the end of October.
A recall petition would not guarantee a fresh election, however. The required threshold would have to be reached before a by-election could be triggered.
Previous recall petitions have produced differing outcomes.
Former Conservative MP Peter Bone faced a recall petition in 2023 after being suspended from the Commons, with 13.2% of registered voters signing it.
Former Labour MP Fiona Onasanya also faced a successful recall petition in 2019, after 27.6% of registered voters signed. In contrast, former DUP MP Ian Paisley Jr avoided a by-election after 9.4% of voters in North Antrim signed a recall petition in 2018, falling short of the 10% threshold.
Former prime minister Boris Johnson resigned as an MP in 2023 before a recommended suspension over the Partygate scandal could be imposed. Farage has previously expressed defiance in the face of opposition to his political return.
After being sworn in as Clacton’s MP for a second time, he said: “If they, as the great and the good, want to stick two fingers up to the voters of Clacton, well, let them do it.”
